NEW YORK, N.Y. -- A New York Judge has put a stop to New York City Mayor Michael Bloomberg's ban on super-size, sugary soft drinks.

Manhattan state Supreme Court Justice Milton Tingling ruled that rules of the law, which was to go into effect Tuesday, are "arbitrary and capricious," applying to only certain beverages and only certain stores, Fox News reported.

Bloomberg continued to defend the ban on Twitter after the ruling.

"Obesity kills more than 5,000 NYers each year. We must take bold steps to fight this crisis," he wrote.

Thank goodness the Judge followed the law and smacked down Emperor Bloomy. We need out-of-touch, power-hungry, billionaire pols like we need more statists in D.C.

I fully agree with the ban. Anyone that is dumb enough to think banning guns will stop crimes should have their soda and cookies taken away!

Do you remember how chocolate caused acne? Teens like chocolate and have acne. But careful experiments showed that chocolate has nothing to do with acne. There are some stains of bacteria that carry out the curse.

is terrific. It is hard to understand how Bloomberg was so successful as a business man and mayor with an Oprah-Show understanding of weight.

I don't agree with Bloomberg telling anyone what they can and cannot do. I don't drink soda but I think the importance here is that we don't go down the slippery slope. What else should the Mayor be able to tell us we can't do? Besides, this attacks soft drinks; as if soda is the culprit behind American obesity. I mean if soda was the "causitive agent" behind New York's obesity problem I would be behind the mayor 100%. It certainly is not.

Unfortunately we have become a nanny state and country. Many people no longer know how to think or do for themselves. Yes we have an obesity problem in this country but this is not the way to go

Looking at the poll above, it is still a little disheartening that 10% of the people are so helpless and stupid, that they want incompetent politicians and bureaucrats to tell them how how to live!
