Wagner, a Democrat and Cortlandt resident, and Murphy, a Republican and councilman in Yorktown, are campaigning in the 40th Senate District. The seat is currently held by Sen. Greg Ball, who declined to seek re-election.

The committee ruled a statement by Murphy's spokesman T.J. McCormack that Wagner supported illegal immigrants serving on juries was unfair. The committee also said a statement by Murphy, a Yorktown councilman, that Wagner hadn't made a decision on how he would vote on the New York is Home Bill is unfair since Wagner said on his Facebook page he would vote against the bill.

“We’re pleased that the Fair Campaign Practices Committee found that Terrence Murphy and his campaign were lying about Justin Wagner’s positions,” said Steve Napier, Wagner's campaign manager. “When Hudson Valley voters see the next round of vicious campaign-season lies, whether it's in a TV ad, a robocall, or printed mail, they need to remember this ruling and that the Terrence Murphy campaign will lie for their own political gain.”

Murphy complained that Wagner sent voters a misleading mailer claiming he is not concerned about the environmental and health concerns associated with the Algonquin pipeline project which the committee ruled was a fair complaint.

The committee rejected his complaint that the mailing did not properly attribute a published quote from a newspaper. The committee also rejected a complaint about a Wagner video that implied Murphy had not taken a position on the Women's Equality Position.

"Once again, Justin Wagner's campaign is spending their day twisting the truth in an effort to hide the fact that their campaign literature has consistently misconstrued Terrence Murphy's stellar record as a local councilman," Matt Slater, Murphy's campaign manager said. "From equal pay for women to protecting our environment, Terrence Murphy already has a record the Hudson Valley can count on and no amount of false advertising by Justin Wagner can change that."

The 40th district covers Mount Kisco, Pleasantville, Mount Pleasant, Chappaqua, Yorktown, Cortlandt, North Salem, Pound Ridge, Lewisboro, Somers, Peekskill and parts of Putnam and Dutchess counties.
