The case had moved last month to a grand jury, which indicted Hengjun Chao, 49.

Chao has been held in the Westchester County jail since his Aug. 29 arrest on suspicion of shooting the men – one of whom was his former boss – outside Lange’s Little Store & Delicatessen.

Chao, a former assistant professor and researcher at the Icahn School of Medicine at Mount Sinai, was fired in 2010 for misconduct.

Authorities believe Chao's former boss, Dr. Dennis Charney, was the intended target of the shooting and that the second man was simply a bystander.

The injuries suffered by Charney and the second shooting victim, whose identity has not been released, were not life-threatening.
