YORKTOWN, N.Y. The Yorktown Town Board gave its consent Tuesday for Highway Superintendent Eric DiBartolo to hire an attorney, whose fees will be paid for by the town, to represent him in a lawsuit filed by a Yorktown resident on behalf of the town.
Attorney Sokoloff was approved as DiBartolos representation in a 4-1 town board vote. Sokoloff represented Council member Nick Bianco years ago and currently is working on a suit that involves police officers and the town, according to the town board.
In the complaint, resident William LaPierre alleges that DiBartolo in his capacity as highway superintendent misappropriated funds from the town, costing taxpayers hundreds of thousands of dollars.
Last week, the board votedwith Council member Vishnu Patel as the only dissenting voteto fund DiBartolos lawyer pending town approval.
The payments to Sokoloff will be made subject to Town Attorney Jeanette Kosters approval of the legal invoices, according to the adopted resolution. Sokoloffs hourly rate is not to exceed $200 per hour, plus reasonable and customary disbursements, the resolution states.
The town board said Koster believed it would be a conflict of interest for her to represent DiBartolo in the suit and she agreed that the town should appoint separate representation for DiBartolo.
The board approved Tuesday's resolution, with Council member Patel again the only dissenting vote.
